The work considers the main problems of understanding the essence of insignificance in the criminal law of Russia and Belarus. An insignificant act is covered in the general context of the crime and its substantial features. The legal nature of insignificance is shown, its connection with public danger and harm, the main features of acts that are not characterized by criminal harmfulness are disclosed.
Particular attention is paid to the analysis of the criteria of insignificance, the establishment of practice-oriented recommendations on the application of the norms of the criminal law in this part and the qualification of unlawful acts. In detail, law enforcement practice is analyzed, the main provisions of the science of criminal law are given and specific measures are proposed to improve the current criminal legislation and judicial practice. The legislation is given as of December 1, 2023
