This monograph is devoted to the issues of interpretation (comparative analysis of comparable provisions of antimonopoly legislation, the practice of its application in the part related to “collective” dominance) and clarification of the FAS Russia No. 15 of 10/24/2018 “On holding responsibility for abuse of business entities recognized as collectively dominant ”(protocol of the Presidium of the FAS Russia No. 11). The phenomena and concepts of “collective” dominance and individual abuse of “collective” dominance, their distinction from agreements and agreed actions, cartel are considered. The impossibility of establishing individual abuse by the “collective” dominant position, objective imputation with such actions of the regulator is justified. A proposal is put forward and substantiated to exclude the institution of “collective” dominance from Russian antimonopoly legislation.
