Insolvency bankruptcy of legal entities. General order. Tutorial
This Textbook is aimed at the initial dive of the student (both undergraduate and graduate levels) in legal relations related to the insolvency (bankruptcy) of the legal entity. The main attention is paid to the general procedure for carrying out the procedure as a pre -trial stage (at the stage of collecting the necessary evidence and compliance with the conditions necessary for applying to the court) and within the framework of the judicial consideration of the dispute about insolvency (bankruptcy). A detailed analysis of basic concepts was carried out, the understanding of which is necessary to understand the essence of the institute under study, key participants in the bankruptcy procedure. The procedural features of a similar category of disputes are indicated and disclosed (since the special bankruptcy law is an interweaving of material and procedural norms inextricably linked with each other), as well as the key moments of individual stages applied in the case of bankruptcy of a legal entity are also set out in detail. In the framework of this training manual, the author intentionally does not explore the features of bankruptcy of certain categories of legal entities, focusing on the general provisions related to the insolvency of the organization. Based on the analysis of judicial practice, key clarifications of the highest instances and the provisions of the law, the essence of key mechanisms for replenishing the property mass of the debtor - the institute of contesting transactions and bringing to subsidiary liability is described in detail.
